These terms govern your use of swamiindiainternational.com (the “Website”), operated by Swami India International Limited (“Swami India”, “we”, “us”, “our”). By using the Website you agree to them. If you do not agree, please do not use the Website. Nothing on this Website forms part of any contract for the sale, lease or construction of property — those are governed solely by the written agreement you sign with us.

1. About us

Swami India International Limited is incorporated in The Gambia under the Companies Act 1955, with its registered office at PO Box 409, Paradise Estate, Coastal Highway, Old Yundum, Banjul, The Gambia. We develop, build, sell and manage residential and commercial property and provide construction and contracting services.

2. Property information is indicative only

We take care to keep the Website accurate, but the material on it is published for general information and marketing purposes and does not constitute an offer, a representation or a warranty of any kind. In particular:

• Prices shown or sent to you from the Website are indicative, exclude taxes, duties, legal fees and registration costs unless stated, and may change without notice until a reservation agreement is signed and the reservation fee paid.
• Availability is updated periodically. A unit shown as available on the interactive floor explorer may already be reserved or sold; only written confirmation from our sales team is binding.
• Renders, photographs, floor plans and 3D views are artists’ impressions or examples of the intended finish. Dimensions, areas, orientation, layouts, materials, fittings, landscaping and views may vary from those illustrated, and furniture and décor are shown for illustration only.
• Areas quoted are approximate gross figures unless otherwise stated and should be verified against the final survey and title documents before purchase.
• Completion and handover dates are targets and may be affected by weather, supply, permitting and other factors outside our control.

You should not rely on the Website alone when deciding to purchase, rent or commission a property. Please visit the site, review the contract documents and take independent legal and financial advice.

3. Enquiries, price lists and reservations

Submitting a form, unlocking a price list or contacting us on WhatsApp is an enquiry only; it does not reserve a unit and creates no obligation on either side. A unit is reserved only when a reservation form has been signed by both parties and the reservation fee has been received in cleared funds. Reservation fees, payment plans, cancellation and refund terms are set out in the reservation and sale agreements for each development and prevail over anything on the Website.

4. Contracting services

Descriptions of our construction, contracting and project-management services are general in nature. Every engagement is subject to a written proposal and contract setting out the scope, programme, price and terms. Indicative timelines and process steps shown on the Website may differ for a particular project.

5. Using the Website

You may browse the Website and print or download pages for your own personal, non-commercial use in connection with a genuine interest in our developments or services. You must not:

• use the Website or our forms to send unsolicited, false or misleading information, or submit someone else’s details without their consent;
• attempt to gain unauthorised access to the Website, its server or any connected system, or introduce viruses or other harmful code;
• scrape, copy or republish the content, images or data (including prices and availability) for any commercial purpose or on any other website without our written permission;
• use our name, logo or images in a way that suggests we endorse or are connected with you.

6. Intellectual property

The Website and everything on it — text, photographs, renders, floor plans, drawings, videos, logos, the “Swami India International” name and the design of the Website itself — are owned by or licensed to Swami India International Limited and are protected by copyright and trade-mark laws. All rights are reserved. Architectural drawings and plans in particular may not be reproduced, adapted or used for construction by any third party.

7. Third-party links and services

The Website contains links to third-party services such as Google Maps, WhatsApp and social-media platforms. These are provided for convenience only. We do not control those services, are not responsible for their content or availability, and their own terms and privacy policies apply when you use them.

8. Availability of the Website

We aim to keep the Website available at all times but do not guarantee that it will be uninterrupted or error-free. We may change, suspend or withdraw any part of it, including the interactive floor explorer and price-list feature, at any time and without notice.

9. Limitation of liability

To the fullest extent permitted by law, Swami India International Limited, its directors, employees and agents accept no liability for any loss or damage — direct, indirect or consequential, including loss of profit, opportunity or data — arising from your use of, or reliance on, the Website or its content, or from any inaccuracy or omission in it. Nothing in these terms limits liability for fraud, or for death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded. Your rights under any signed sale, tenancy or contracting agreement are unaffected by this clause and are governed by that agreement.

10. Privacy

Personal information you give us through the Website is handled in accordance with our Privacy Policy, which forms part of these terms.

11. Governing law

These terms, and any dispute or claim arising out of your use of the Website, are governed by the laws of the Republic of The Gambia, and the courts of The Gambia have exclusive jurisdiction. If any part of these terms is found to be unenforceable, the rest continues to apply.

12. Changes to these terms

We may revise these terms at any time by updating this page. The date at the top shows the current version; please check it whenever you use the Website. Continued use after a change means you accept the revised terms.
